{"id":1436,"date":"2013-03-12T07:06:10","date_gmt":"2013-03-12T07:06:10","guid":{"rendered":"http:\/\/www.marijuana.net\/?p=20727"},"modified":"2013-03-12T07:06:10","modified_gmt":"2013-03-12T07:06:10","slug":"long-wait-for-medical-marijuana-in-maryland-may-soon-be-over","status":"publish","type":"post","link":"https:\/\/cannitrol.com\/blog\/long-wait-for-medical-marijuana-in-maryland-may-soon-be-over\/","title":{"rendered":"Long Wait for Medical Marijuana in Maryland May Soon be Over"},"content":{"rendered":"<div id=\"wp_fb_like_button\" style=\"margin:5px 0 5px 5px;float:right;height:100px;\"><script src=\"http:\/\/connect.facebook.net\/en_US\/all.js#xfbml=1\"><\/script><fb:like href=\"https:\/\/cannitrol.com\/blog\/long-wait-for-medical-marijuana-in-maryland-may-soon-be-over\/\" send=\"true\" layout=\"standard\" width=\"450\" show_faces=\"false\" font=\"arial\" action=\"like\" colorscheme=\"light\"><\/fb:like><\/div><p><img loading=\"lazy\" width=\"3072\" height=\"2044\" src=\"http:\/\/www.marijuana.net\/wp-content\/uploads\/martin-o-malley.jpg\" class=\"attachment-post-thumbnail wp-post-image\" alt=\"martin o malley\" title=\"martin o malley\" \/><\/p>\n<p><a rel=\"attachment wp-att-20728\" href=\"http:\/\/www.marijuana.net\/news-and-articles\/long-wait-for-medical-marijuana-in-maryland-may-soon-be-over\/attachment\/martin-o-malley\/\"><img loading=\"lazy\" class=\"alignleft size-thumbnail wp-image-20728\" title=\"martin o malley\" src=\"http:\/\/www.marijuana.net\/wp-content\/uploads\/martin-o-malley-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" \/><\/a>Although a solid majority of Americans have been supporting marijuana reform, many lawmakers are still hesitant to cross swords with the federal government.\u00a0 Many of our leaders have decided doing nothing would be a safer choice than to take any new and bold legislative direction.<\/p>\n<p><a href=\"http:\/\/www.gov.state.md.us\/\" target=\"_blank\">Governor Martin O\u2019Malley<\/a> has often found himself between this federal rock and public hard place. \u00a0Mr. O\u2019Malley has not exactly been on the side of activists looking to change marijuana law.\u00a0 However, he has not taken a dramatic public stance against marijuana reform as other politicians have.\u00a0 For the past several years, there have been multiple attempts by both lawmakers and activists to set up a viable medical marijuana program.\u00a0 Maryland\u2019s governor has stated that he is afraid of state employees facing federal prosecution.<\/p>\n<p>The result has been a legal stalemate and created a convoluted legal situation for Maryland residents.\u00a0 \u00a0\u00a0Medical marijuana is not permitted per se, however, a 2003 law allows for a possible medical marijuana defense.\u00a0 If an individual is arrested for marijuana, and can prove in court that they have a medical necessity to use cannabis, then a judge can reduce their sentence to as little as a $100 fine.\u00a0 However, if a state does not recognize even one condition as qualifying for medical use, exactly what guidelines are judges using to determine if a patient\u2019s legitimate medical use?<\/p>\n<p>Fortunately, it seems Governor O\u2019Malley is going to help bring clarity to the situation.\u00a0 At the very least he is willing to step aside as lawmakers consider a bill to legalize medical marijuana in Maryland.\u00a0 Last year the governor threatened to veto the bill but has since changed his mind.\u00a0 <a href=\"http:\/\/msa.maryland.gov\/msa\/mdmanual\/16dhmh\/html\/msa15523.html\" target=\"_blank\">Dr. Joshua M.
