{"id":5691,"date":"2016-03-13T08:25:44","date_gmt":"2016-03-13T08:25:44","guid":{"rendered":"http:\/\/www.marijuana.com\/?p=47790"},"modified":"2016-03-13T08:25:44","modified_gmt":"2016-03-13T08:25:44","slug":"ohio-attorney-general-rejects-medical-marijuana-ballot-language","status":"publish","type":"post","link":"https:\/\/cannitrol.com\/blog\/ohio-attorney-general-rejects-medical-marijuana-ballot-language\/","title":{"rendered":"Ohio Attorney General Rejects Medical Marijuana Ballot Language"},"content":{"rendered":"<div id=\"wp_fb_like_button\" style=\"margin:5px 0 5px 5px;float:right;height:100px;\"><script src=\"http:\/\/connect.facebook.net\/en_US\/all.js#xfbml=1\"><\/script><fb:like href=\"https:\/\/cannitrol.com\/blog\/ohio-attorney-general-rejects-medical-marijuana-ballot-language\/\" send=\"true\" layout=\"standard\" width=\"450\" show_faces=\"false\" font=\"arial\" action=\"like\" colorscheme=\"light\"><\/fb:like><\/div><p>Efforts to put a medical marijuana measure on Ohio&#8217;s November ballot hit a snag Friday when Attorney General Mike DeWine ruled that a summary of the initiative provided by advocates is not fair and truthful.<\/p>\n<p>&#8220;There are a number of discrepancies between the summary and the proposed amendment,&#8221; DeWine wrote in a <a href=\"http:\/\/www.ohioattorneygeneral.gov\/getattachment\/32199ed2-2304-46e2-aec0-bfedb2d410a9\/Medical-Use-of-Marijuana.aspx\">letter<\/a> to Rob Kampia of the Marijuana Policy Project (MPP), a national group coordinating medical cannabis efforts in the state.<\/p>\n<p>The <a href=\"http:\/\/www.marijuana.com\/blog\/news\/2016\/02\/details-emerge-about-2016-ohio-medical-marijuana-measure\/\">measure<\/a>, if passed by voters,&nbsp;would allow patients with doctors&#8217; recommendations to purchase medical marijuana from licensed dispensaries. They would also be authorized to grown their own cannabis at home.<\/p>\n<p>But DeWine said that there are discrepancies between the summary MPP&#8217;s local campaign committee, Ohioans for Medical Marijuana, prepared and the full measure&#8217;s text.<\/p>\n<p>For example, the summary says that under the measure, state regulators &#8220;shall issue no more than fifteen [large scale]&nbsp;medical marijuana cultivation facility licenses&#8221; whereas the full text allows for more such licenses to be granted if it is determined that they would be &#8220;necessary to meet the demand for medical marijuana by qualifying patients.&#8221;<\/p>\n<p>Another passage in the summary describes ways patients can get the ID cards that would authorize them to use medical cannabis if state regulators are dragging their feet on issuing regulations after July 1, 2017. But the measure itself sets those&nbsp;provisions as effective after August 1, 2017.<\/p>\n<p><span style=\"line-height: 1.5\">There is also one apparent discrepancy DeWine identified regarding driving under the influence of marijuana.<\/span><\/p>\n<p>&#8220;We appreciate the attorney general\u2019s feedback and we\u2019ll be resubmitting our revised petition next week,&#8221; Mason Tvert, MPP&#8217;s director of communications, told Marijuana.com in an email. &#8220;This is just part of Ohio\u2019s very rigorous initiative process, so it\u2019s not particularly surprising.
