{"id":7140,"date":"2017-01-14T01:58:36","date_gmt":"2017-01-14T01:58:36","guid":{"rendered":"http:\/\/www.denverpost.com?p=2361748&amp;preview_id=2361748"},"modified":"2017-01-14T01:58:36","modified_gmt":"2017-01-14T01:58:36","slug":"hemp-industry-members-file-legal-challenge-against-deas-new-marijuana-extract-rule","status":"publish","type":"post","link":"https:\/\/cannitrol.com\/blog\/hemp-industry-members-file-legal-challenge-against-deas-new-marijuana-extract-rule\/","title":{"rendered":"Hemp industry members file legal challenge against DEA\u2019s new marijuana extract rule"},"content":{"rendered":"<div id=\"wp_fb_like_button\" style=\"margin:5px 0 5px 5px;float:right;height:100px;\"><script src=\"http:\/\/connect.facebook.net\/en_US\/all.js#xfbml=1\"><\/script><fb:like href=\"https:\/\/cannitrol.com\/blog\/hemp-industry-members-file-legal-challenge-against-deas-new-marijuana-extract-rule\/\" send=\"true\" layout=\"standard\" width=\"450\" show_faces=\"false\" font=\"arial\" action=\"like\" colorscheme=\"light\"><\/fb:like><\/div><p>The hemp industry has taken the DEA to court in the wake of a controversial new rule on marijuana extracts.<\/p>\n<p>Denver\u2019s Hoban Law Group, representing the Hemp Industries Association, Centuria Natural Foods and RMH Holdings LLC, on Friday filed a judicial review action against the U.S. Drug Enforcement Administration, alleging the agency overstepped its bounds when <a href=\"http:\/\/www.thecannabist.co\/2016\/12\/15\/dea-cbd-new-rule-marijuana-extracts\/69550\/\">enacting a rule establishing coding for marijuana derivatives such as cannabidiol (CBD) oil<\/a>. The action, Hoban attorneys allege, puts at risk a booming cannabis and hemp industry and a wide variety of hemp-based products currently on the market.<\/p>\n<p>\u201cWe\u2019re talking about jobs and the economy and agricultural (revival),\u201d attorney Bob Hoban said in an interview with The Cannabist on Friday.<\/p>\n<p>The DEA last month confounded many in the cannabis industry with the <a href=\"https:\/\/www.federalregister.gov\/documents\/2016\/12\/14\/2016-29941\/establishment-of-a-new-drug-code-for-marihuana-extract\">filing of a final rule notice<\/a> establishing a Controlled Substances Code Number for \u201cmarihuana extract,\u201d and subsequently maintaining marijuana, hemp and their derivatives as Schedule I substances.<\/p>\n<aside class=\"related right\" \/>\n<p>DEA officials said the code number would assist in the tracking of materials for research and would aid in complying with treaty provisions.
