{"id":7198,"date":"2017-02-03T17:19:44","date_gmt":"2017-02-03T17:19:44","guid":{"rendered":"http:\/\/www.denverpost.com\/?p=2400293"},"modified":"2017-02-03T17:19:44","modified_gmt":"2017-02-03T17:19:44","slug":"richard-kirk-accused-in-observatory-park-slaying-of-his-wife-pleads-guilty-to-second-degree-murder","status":"publish","type":"post","link":"https:\/\/cannitrol.com\/blog\/richard-kirk-accused-in-observatory-park-slaying-of-his-wife-pleads-guilty-to-second-degree-murder\/","title":{"rendered":"Richard Kirk, accused in Observatory Park slaying of his wife, pleads guilty to second-degree murder"},"content":{"rendered":"<div id=\"wp_fb_like_button\" style=\"margin:5px 0 5px 5px;float:right;height:100px;\"><script src=\"http:\/\/connect.facebook.net\/en_US\/all.js#xfbml=1\"><\/script><fb:like href=\"https:\/\/cannitrol.com\/blog\/richard-kirk-accused-in-observatory-park-slaying-of-his-wife-pleads-guilty-to-second-degree-murder\/\" send=\"true\" layout=\"standard\" width=\"450\" show_faces=\"false\" font=\"arial\" action=\"like\" colorscheme=\"light\"><\/fb:like><\/div><figure id=\"attachment_2172426\" class=\"wp-caption alignright size-article_inline_third\"><a href=\"http:\/\/www.denverpost.com\/wp-content\/uploads\/2016\/09\/richard_kirk.jpg\"><img class=\" lazyload\" src=\"https:\/\/cannitrol.com\/blog\/\/wp-content\/uploads\/2017\/02\/richard-kirk-accused-in-observatory-park-slaying-of-his-wife-pleads-guilty-to-second-degree-murder\" alt=\"Richard Kirk\" width=\"2400\" \/><\/a><figcaption class=\"wp-caption-text\">\n<p>Denver Police Department<\/p>\n<p>Richard Kirk<\/figcaption><\/figure>\n<p>A man who claimed that eating marijuana candy led him to shoot his wife to death in their Observatory Park home pleaded guilty Friday to second-degree murder, ending a years-long debate\u00a0<a href=\"http:\/\/www.denverpost.com\/2016\/05\/10\/lawsuit-against-marijuana-company-over-deadly-denver-shooting-could-be-first-of-its-kind\/\">surrounding pot<\/a> and its possible influence on the slaying.<\/p>\n<p>Richard Kirk, 50, agreed to serve 25 to 30 years in prison as part of his plea, and to relinquish custody of his three children.<\/p>\n<p>Kirk killed his terrified wife, Kristine, as she pleaded with a Denver 911 operator for help, saying <a href=\"http:\/\/www.denverpost.com\/2014\/04\/15\/denver-woman-spent-13-minutes-on-911-call-before-being-shot-to-death\/\">over a 13-minute phone call<\/a>\u00a0 April 14, 2014, that her husband was ranting about the end of the world and asking her to kill him.<\/p>\n<p>Kirk is set to be sentenced April 7.<\/p>\n<p>The family of Kristine issued a statement after the plea was entered, saying: \u201cWe miss Kris every day. We are grateful that this case has been resolved to save us all from the stress of a trial.\u201d<\/p>\n<p>As part of the plea, Kirk also will serve five years of parole after his release from prison. His children will be <a href=\"http:\/\/www.denverpost.com\/2014\/08\/26\/family-of-observatory-park-victim-works-to-rebuild-life-for-her-sons\/\">adopted by Kristine Kirk\u2019s parents<\/a>,\u00a0Marti and Wayne Kohnke.<\/p>\n<p>Just weeks before his trial on first-degree murder charge was scheduled to begin in 2015, Kirk\u2019s attorneys <a href=\"http:\/\/www.denverpost.com\/2016\/03\/17\/months-after-insanity-plea-no-evaluation-for-kirk-in-wifes-murder\/\">changed his plea from not guilty to not guilty by reason of insanity<\/a>, citing marijuana intoxication. That trial was delayed because a judge had <a href=\"http:\/\/www.denverpost.com\/2016\/03\/17\/months-after-insanity-plea-no-evaluation-for-kirk-in-wifes-murder\/\">ordered a mental-health evaluation<\/a> to determine whether Kirk was competent to stand trial.<\/p>\n<p>Kirk\u00a0<a href=\"http:\/\/www.denverpost.com\/2016\/09\/29\/richard-kirk-observatory-park-marijuana-killing-wife-insanity-plea\/\">was set to<\/a>\u00a0face a trial next month, which has now been vacated. Prosecutors dropped the first-degree murder charge, which could have landed Kirk behind bars for the rest of his life.<\/p>\n<p>Kirk, who was dressed in a gray jail jumpsuit Friday, was stooped and appeared to have aged dramatically since initial charges were filed. His hair was almost all gray.<\/p>\n<p>\u201cWe have reached a disposition,\u201d prosecutor Helen Morgan told Denver District Judge Martin Egelhoff.<\/p>\n<p>Egelhoff asked Kirk a series of questions, probing to see whether he was mentally fit to plead guilty. Kirk itemized a long list of medications he is taking for anxiety, sleep deprivation, high cholesterol and depression.<\/p>\n<p>He stood at a lectern and answered Egelhoff\u2019s questions with a series of \u201cyes\u201d answers, acknowledging the trial rights he was giving up by pleading guilty.<\/p>\n<p>Kirk shook hands with his attorneys after the hearing. Public Defender Chris Bauman declined to comment after the plea was entered. \u201cWe\u2019ll have a lot to say on the seventh.\u201d<\/p>\n<aside class=\"related right\" \/>\n<p>Kirk had purchased and partially consumed marijuana-infused candy before killing his wife while the couple\u2019s three sons were in the home.<\/p>\n<p>Before the shooting, Kristine Kirk <a href=\"http:\/\/www.denverpost.com\/2014\/04\/15\/denver-woman-spent-13-minutes-on-911-call-before-being-shot-to-death\/\">called 911 to ask for help<\/a>.\u00a0She said she was scared of her husband, who was ranting and jumping in and out of windows, according to previous reports.<\/p>\n<p>Kristine Kirk <a href=\"http:\/\/www.denverpost.com\/2014\/04\/15\/denver-woman-spent-13-minutes-on-911-call-before-being-shot-to-death\/\">told the 911 operator<\/a>\u00a0her husband was \u201ctalking about the end of the world and he wanted her to shoot him,\u201d according to a probable cause statement. She also told the operator there was a gun in the house, but that it was kept in a safe. Before police arrived, Kristine screamed over the phone until a single shot was fired.<\/p>\n<p>Police have said officers had almost reached the home when the shooting happened.<\/p>\n<p>A partially eaten \u201cKarma Kandy Orange Ginger\u201d candy was found at Kirk\u2019s home after the shooting. The candy \u2014 which was about the size of a Tootsie Roll \u2014 contained 10 servings of THC, with each serving containing about 10 milligrams.<\/p>\n<p>Prosecutors had rejected any arguments that Kirk was not acting intentionally. They claimed the financial and emotional strain of his marriage contributed to a conscious decision to kill his wife.<\/p>\n<p>\u201cAll involved feel this is a fair resolution of a very complicated, tragic case,\u201d said Denver District Attorney Beth McCann. \u201cThe family did not want the case to go to trial given the personal and emotional toll family members have already suffered.
