The legislation is modeled after <a href=\"https:\/\/www.oregon.gov\/olcc\/marijuana\/Pages\/FAQs-Licensing-Transportation-Delivery.aspx\">Oregon\u2019s newly launched<\/a> marijuana home delivery regulations, said Rep. Jonathan Singer, D-Longmont, who co-sponsored the bill with Sen. Tim Neville, R-Littleton, and Rep. Jovan Melton, D-Aurora.<\/p>\n<p>\u201cThis hopefully solves some of the problems as it relates to people concerned about marijuana DUIs or sick patients who don\u2019t have access to dispensaries,\u201d Singer told The Cannabist in a phone interview Friday.<\/p>\n<p>Colorado\u2019s bill goes a step further to also try to put in place a Plan B should there be a major change in <a href=\"http:\/\/www.thecannabist.co\/2017\/02\/08\/attorney-general-jeff-sessions-marijuana-scenarios\/73321\/\">federal enforcement policy<\/a> \u2014 or local or state, for that matter.<\/p>\n<p>SB 192\u2019s language calls for single-instance transfers of product from a retail marijuana store to a medical dispensary \u2014 effectively creating a \u201csafety valve\u201d for the state\u2019s operations, Singer said.<\/p>\n<p>For example, if a municipality were to ban recreational marijuana or federal crackdown occured, affected businesses would be allowed to transfer their inventory to a medical dispensary.<\/p>\n<p>\u201cThis ensures that we have safe passage \u2026 and it doesn\u2019t escape out the back door,\u201d he said.<\/p>\n<p>The meat of SB 192, however, is dedicated to delivery regulations.<\/p>\n<p>Among the notable provisions:<\/p>\n<ul>\n<li>Medical marijuana dispensaries and retail marijuana shops can apply for a delivery \u201cendorsement\u201d from the state, which would allow an employee or approved contractor to deliver flower, concentrate and infused products to adults over the age of 21 and parents and guardians of a medical marijuana card holder.<\/li>\n<li>A local jurisdiction could not prohibit the delivery of medical or recreational marijuana by a licensed entity<\/li>\n<li>The daily purchase limits apply (one ounce recreational cannabis flower or equivalent products; two ounces medical)<\/li>\n<li>Licensed delivery operations need to meet specific training procedures, including age verification, record-keeping, security, vehicle requirements, and limits on the amount of product that could be carried in a vehicle<\/li>\n<li>Inventory tracking, transportation, packaging and labeling requirements apply<\/li>\n<li>Endorsements for medical marijuana begin Jan. 2, 2018, and the endorsements for retail marijuana begin Jan. 2, 2019<\/li>\n<\/ul>\n<p>The bill is scheduled for a hearing March 1 with the Senate Business, Labor, &amp; Technology committee. <\/p>\n<p>In Oregon, home delivery is still a fresh concept, having launched just this month.<\/p>\n<p>\u201cIt\u2019s super exciting,\u201d Spencer Krutzler, manager of La Cannaisseur in Linnton, <a href=\"http:\/\/www.kgw.com\/life\/marijuana-home-delivery-starts-in-oregon\/406724967\">told KGW.com<\/a>. \u201cThis is like, you\u2019re going to call the pizza guy, then you\u2019re going to call us. We\u2019re going to have a good time.\u201d<\/p>\n<p>The Oregon Liquor Control Commission oversees the regulations for recreational cannabis, <a href=\"https:\/\/www.oregon.gov\/olcc\/marijuana\/Documents\/Licensing_Forms\/mj_opt_ret_delivery_FILLABLE.pdf\">including how the deliveries work<\/a>.<\/p>\n<p>Outside of residential homes, there are limits on where a recreational customer can have their cannabis delivered: Public spaces such as parks or campgrounds are out; also excluded are dormitories, motels, bed &amp; breakfasts or other similar commercial businesses. <\/p>\n<p>Delivery workers must verify that the person receiving the order is the same person who placed the order; is age 21 or older and not visibly intoxicated; and the person must sign for the order.<\/p>\n<p>Deliveries are closely tracked. Route manifests are required for the state\u2019s Cannabis Tracking System and must include the driver\u2019s inventory of products and their retail amount, the number of locations and the route between destinations.
