{"id":7339,"date":"2017-04-13T04:12:22","date_gmt":"2017-04-13T04:12:22","guid":{"rendered":"http:\/\/www.denverpost.com?p=2613417&amp;preview_id=2613417"},"modified":"2017-04-13T04:12:22","modified_gmt":"2017-04-13T04:12:22","slug":"denver-officials-scrutinizing-out-of-state-cbd-products-sold-in-local-pot-shops","status":"publish","type":"post","link":"https:\/\/cannitrol.com\/blog\/denver-officials-scrutinizing-out-of-state-cbd-products-sold-in-local-pot-shops\/","title":{"rendered":"Denver officials scrutinizing out-of-state CBD products sold in local pot shops"},"content":{"rendered":"<div id=\"wp_fb_like_button\" style=\"margin:5px 0 5px 5px;float:right;height:100px;\"><script src=\"http:\/\/connect.facebook.net\/en_US\/all.js#xfbml=1\"><\/script><fb:like href=\"https:\/\/cannitrol.com\/blog\/denver-officials-scrutinizing-out-of-state-cbd-products-sold-in-local-pot-shops\/\" send=\"true\" layout=\"standard\" width=\"450\" show_faces=\"false\" font=\"arial\" action=\"like\" colorscheme=\"light\"><\/fb:like><\/div><div class=\"row\" id=\"sticky-outer\">\n<div class=\"large-11 small-12 columns\">\n<div class=\"entry-meta-date\">Published: Apr 12, 2017, 6:56 pm \u2022 Updated: Apr 12, 2017, 6:56 pm<span class=\"single-comments-link\"><a href=\"http:\/\/www.thecannabist.co\/2017\/04\/12\/denver-officials-scrutinizing-state-cbd-products-sold-local-pot-shops\/77205\/#disqus_thread\" class=\"commentsNameLink\" \/><\/span><\/div>\n<p class=\"byline\">By <span class=\"author\"><a class=\"url fn n\" href=\"http:\/\/www.thecannabist.co\/author\/awallace\/\" rel=\"author\">Alicia Wallace<\/a><\/span><em>, The Cannabist Staff<\/em><\/p>\n<p>Denver is clamping down on CBD products that originate outside of Colorado.<\/p>\n<p>A bulletin issued Wednesday by Denver Environmental Health\u2019s Public Health Inspections Division outlines a policy prohibiting out-of-state-made cannabidiol (CBD) products intended for human consumption. <\/p>\n<p>\u201cIt has come to DEH\u2019s attention that some CBD products originate from unregulated manufacturing facilities, have been illegally shipped across state lines, contain unapproved ingredients, or have been made in unsafe manufacturing conditions,\u201d officials wrote in the <a href=\"https:\/\/www.denvergov.org\/content\/dam\/denvergov\/Portals\/771\/documents\/PHI\/Food\/CBDdocument.pdf\" target=\"_blank\">bulletin<\/a>. \u201cWhen DEH encounters these products, retailers and manufacturers may be subject to DEH enforcement and requests for additional information to demonstrate that the product was manufactured safely.\u201d<\/p>\n<p>Although Denver regulates and inspects local manufacturers of ingested and inhaled CBD products, not all of the CBD items sold in Denver are subject to those regulations. Some products with CBD, a component of the cannabis plant that is non-psychoactive unlike THC, are sourced from outside of Denver, the state of Colorado and the United States, and are made without the oversight of any regulatory agency, officials said.<\/p>\n<p>Manufacturers who cannot demonstrate whether their products came from standardized processes in a safe facility could be subject to enforcement action and restrictions in Denver, officials said. <\/p>\n<p>Denver officials have started contacting CBD product manufacturers in addition to authorities from other jurisdictions and the state, said Abby Davidson, the Public Health Inspection Division\u2019s food safety and marijuana program manager. For products manufactured outside of Denver but in Colorado, officials plan to evaluate those on a case-by-case basis, she added.<\/p>\n<p>\u201cCBD is a therapeutic product and that\u2019s something that really made us feel that this is an important issue \u2014 to make sure the products on the shelf (for human consumption) are safe,\u201d Abby Davidson, Public Health Inspections Division\u2019s food safety and marijuana program manager, told The Cannabist.<\/p>\n<p>Some of the city\u2019s chief concerns with various CBD products are that they come from other countries; are improperly labeled; boast unsubstantiated health claims; contain unsafe additives; and are made in facilities that do not have proper standards such as sanitizing and hand-washing, she said.<\/p>\n<p>\u201cWe didn\u2019t really understand the breadth of the CBD industry and, up until hearing some more from operators and them reaching out to us, we didn\u2019t even fathom that CBD sources were possibly coming from out of the country,\u201d she said.<\/p>\n<p>Earlier this year, the U.S. Drug Enforcement Administration <a href=\"http:\/\/www.thecannabist.co\/2016\/12\/15\/dea-cbd-new-rule-marijuana-extracts\/69550\/\">enacted a new rule<\/a> that established a drug code for \u201cmarihuana extracts,\u201d such as CBD oil. DEA officials said the change was purely administrative and was made to assist with research requests; however, hemp industry advocates have argued \u2014 <a href=\"http:\/\/www.thecannabist.co\/2017\/01\/13\/hemp-dea-extracts-marijuana-cbd-judicial-review\/71387\/\">and subsequently filed a legal complaint<\/a> \u2014 that the code and comments that CBD is a Schedule I substance open the door for enforcement action against the products.<\/p>\n<p>Denver officials\u2019 experiences were the impetus for the city\u2019s policy change, she said.<\/p>\n<p>\u201cI do know that we did not receive any directive from the (U.S. Drug Enforcement Administration) to take action,\u201d she said. \u201cDenver has some unique authorities that let us really do what we\u2019re here to do: It\u2019s to protect the consumer. Our role is to protect the consumer and err on the side of caution.\u201d<\/p>\n<p>When reached late Wednesday, Robert Goulding, the spokesman for Colorado\u2019s Marijuana Enforcement Division, said that \u201cif any MED-licensed facilities are selling out-of-state marijuana or marijuana products, that would be a clear violation of MED rules and\/or statute.\u201d <\/p>\n<p>As soon as Denver-based Peak MJ dispensary owner Justin Henderson saw the bulletin, he and staff members started to pore through the shop\u2019s CBD offerings.
