{"id":7489,"date":"2017-06-20T17:55:26","date_gmt":"2017-06-20T17:55:26","guid":{"rendered":"http:\/\/www.denverpost.com\/?p=2689834"},"modified":"2017-06-20T17:55:26","modified_gmt":"2017-06-20T17:55:26","slug":"colorado-supreme-court-wont-hear-adams-countys-appeal-over-its-pot-tax-battle-with-cities","status":"publish","type":"post","link":"https:\/\/cannitrol.com\/blog\/colorado-supreme-court-wont-hear-adams-countys-appeal-over-its-pot-tax-battle-with-cities\/","title":{"rendered":"Colorado Supreme Court won\u2019t hear Adams County\u2019s appeal over its pot tax battle with cities"},"content":{"rendered":"<div id=\"wp_fb_like_button\" style=\"margin:5px 0 5px 5px;float:right;height:100px;\"><script src=\"http:\/\/connect.facebook.net\/en_US\/all.js#xfbml=1\"><\/script><fb:like href=\"https:\/\/cannitrol.com\/blog\/colorado-supreme-court-wont-hear-adams-countys-appeal-over-its-pot-tax-battle-with-cities\/\" send=\"true\" layout=\"standard\" width=\"450\" show_faces=\"false\" font=\"arial\" action=\"like\" colorscheme=\"light\"><\/fb:like><\/div><p>The Colorado Supreme Court this week declined to hear an appeal by Adams County over the validity of its recreational marijuana tax in three of its cities, raising questions about the fate of the nearly $2 million the county has brought in over the last two years from the levy.<\/p>\n<p>The high court\u2019s decision keeps in place a ruling by the Colorado Court of Appeals last year, <a href=\"http:\/\/www.denverpost.com\/2016\/12\/15\/adams-county-return-marijuana-taxes-collected-to-fund-scholarships\/\">which concluded that Adams County had been improperly collecting a 3 percent tax on recreational pot<\/a> in Commerce City, Aurora and Northglenn, stands.<\/p>\n<p>Adams County has used <a href=\"http:\/\/www.denverpost.com\/2017\/05\/26\/adams-county-scholarship-fund-disputed-tax-revenue\/\">hundreds of thousands of dollars of its pot tax revenues to fund college scholarships<\/a> for underprivileged students. A spokesman for the county on Tuesday said the county had stopped collecting the tax several weeks ago, but it\u2019s not clear what the Supreme Court decision means for the more than $1.8 million that Adams County has since the tax went into effect on July 1, 2015.<\/p>\n<p>Northglenn city manager James Hayes said in a statement that the Colorado Supreme Court\u2019s decision \u201cis in support of municipal government and local businesses.\u201d<\/p>\n<p>\u201cWe were confident from the beginning that Adams County didn\u2019t have the authority under state\u00a0law to impose a special sales tax only on marijuana,\u201d he said.<\/p>\n<p>The <a href=\"http:\/\/www.denverpost.com\/2015\/05\/28\/adams-county-sued-by-three-of-its-cities-over-targeted-pot-tax\/\">cities initially sued in district court<\/a>,\u00a0claiming Adams County\u00a0didn\u2019t have the authority under state law to tax a single product.
