In addition to the 29 states, the District of Columbia, Guam and Puerto Rico that have legalized some forms of marijuana, 18 states allow use of CBD-rich products for medical purposes, according to the <a href=\"http:\/\/www.ncsl.org\/research\/health\/state-medical-marijuana-laws.aspx\">National Conference of State Legislatures<\/a>.<\/p>\n<p>CBD has recently become more widely available \u2014 <a href=\"http:\/\/www.thecannabist.co\/2017\/10\/09\/luckys-market-cbd-oil-hemp-extracts-nationwide\/89449\/\">it\u2019s even in mainstream grocery chains<\/a> \u2014 and it appears the cannabis compound is confounding state law enforcement agencies and news outlets.<\/p>\n<p>The Halloween weed scare of 2017 appears to have originated in North Carolina, where medical cannabidiol was legalized in July 2015.<\/p>\n<p><img loading=\"lazy\" src=\"https:\/\/cannitrol.com\/blog\/\/wp-content\/uploads\/2017\/10\/cbd-candy-is-this-years-halloween-bogeyman.jpg\" alt=\"\" width=\"1018\" height=\"421\" class=\"aligncenter size-full wp-image-91103\" \/><\/p>\n<p>On Oct. 20, Charlotte NBC affiliate <a href=\"http:\/\/www.wcnc.com\/news\/crime\/authorities-tracking-candies-that-could-get-kids-high\/484952378\">WCNC reported<\/a> CBD candies have become \u201ca nightmare for state drug enforcement agencies as Halloween draws near.\u201d<\/p>\n<p>After outlining that CBD is not psychoactive like THC, the report warns: \u201cbut it\u2019s known to give users a relaxing feeling.\u201d<\/p>\n<p><img loading=\"lazy\" src=\"https:\/\/cannitrol.com\/blog\/\/wp-content\/uploads\/2017\/10\/cbd-candy-is-this-years-halloween-bogeyman-1.jpg\" alt=\"\" width=\"635\" height=\"112\" class=\"aligncenter size-full wp-image-91102\" \/><\/p>\n<p>The same evening, <a href=\"http:\/\/www.wral.com\/authorities-concerned-about-candy-that-could-get-kids-high\/17032543\/\">WRAL Raleigh reported<\/a> that state law enforcement officers were sounding the alarm about \u201cgummie candy and lollipops containing cannabidiol.\u201d<\/p>\n<blockquote>\n<p>Cumberland County Sheriff Ennis Wright said his school resource officers haven\u2019t come across any of the CBD products on school campuses, but the color of the packaging concerns him.<\/p>\n<p>\u201cBeing that Halloween is coming up, this package here basically favors the Halloween colors,\u201d Wright said. \u201cI want to inform these parents to ensure that they look at every piece of candy that these young people are bringing home.\u201d<\/p>\n<p>Jason Locklear, an agent with the state Division of Alcohol Law Enforcement, said shops in the Cumberland County area are sold out of lollipops with CBD. He\u2019s also concerned about a vaporless inhaler that gives a person a hit of the compound.<\/p>\n<\/blockquote>\n<p>The modern media marketplace then amplified the story to the largest news markets in the country. The WRAL piece was picked up this week by <a href=\"http:\/\/www.nydailynews.com\/news\/national\/police-warn-parents-cbd-oil-candies-halloween-article-1.3585146\">The New York Daily News<\/a> and <a href=\"http:\/\/www.chron.com\/news\/nation-world\/nation\/article\/gummi-candy-lollipop-marijuana-cannabidiol-CBD-THC-12299911.php\">Houston Chronicle<\/a>, which ran the story word-for-word but did dutifully observe in a subhead: \u201cCannabidiol will be legal in Texas medical marijuana dispensaries starting next year.\u201d<\/p>\n<p><img loading=\"lazy\" src=\"https:\/\/cannitrol.com\/blog\/\/wp-content\/uploads\/2017\/10\/cbd-candy-is-this-years-halloween-bogeyman-2.jpg\" alt=\"\" width=\"912\" height=\"129\" class=\"size-full wp-image-91105\" \/><\/p>\n<p>Meanwhile, WCNC Charlotte\u2019s \u201cCBD candy\u201d report was <a href=\"http:\/\/www.wkyc.com\/news\/health\/parents-warned-to-look-out-for-candies-that-could-get-kids-high\/485560466\">rebroadcast by Cleveland\u2019s NBC affiliate<\/a>, WKYC this week. Tampa, Fla., NBC affiliate WFLA also picked up the story, <a href=\"http:\/\/wfla.com\/2017\/10\/23\/parents-warned-to-watch-out-for-candy-that-can-get-kids-high\/\">adding a Sunshine State-specific reporting<\/a>:<\/p>\n<blockquote>\n<p>The Poison Center at Tampa General Hospital is warning parents to be on the lookout for these candies.<\/p>\n<p>Dr. Fred Aleguas is urging parents to double check all candy wrappers closely. He is also issuing a reminder to not let your kids eat any homemade goodies passed out during trick-or-treating.<\/p>\n<\/blockquote>\n<p>WFLA\u2019s story was then <a href=\"http:\/\/news10.com\/2017\/10\/24\/parents-warned-to-watch-out-for-candy-that-can-get-kids-high\/\">picked up by Albany, N.Y. ABC affiliate News 10<\/a>, which didn\u2019t add an Empire State angle.<\/p>\n<p><img loading=\"lazy\" src=\"https:\/\/cannitrol.com\/blog\/\/wp-content\/uploads\/2017\/10\/cbd-candy-is-this-years-halloween-bogeyman-3.jpg\" alt=\"\" width=\"531\" height=\"72\" class=\"aligncenter size-full wp-image-91111\" \/><\/p>\n<p>Despite <a href=\"http:\/\/www.thecannabist.co\/2014\/11\/03\/reports-kids-getting-pot-laced-treats-halloween-candy\/22405\/\">zero evidence of THC-laced treats being handed out to children<\/a> since legalization took root in Colorado and Washington, Halloween 2017 has seen its share of marijuana candy sensationalism.<\/p>\n<p>The New Jeresey Attorney General <a href=\"https:\/\/twitter.com\/NewJerseyAG\/status\/922876028124565511\">published a pamphlet<\/a> Wednesday warning, \u201cThere is a significant presence of marijuana candy and other edible forms in New Jersey and nearby states.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Parents: Check <a href=\"https:\/\/twitter.com\/hashtag\/Halloween?src=hash&amp;ref_src=twsrc%5Etfw\">#Halloween<\/a> candy for <a href=\"https:\/\/twitter.com\/hashtag\/marijuana?src=hash&amp;ref_src=twsrc%5Etfw\">#marijuana<\/a> infused candy. <a href=\"https:\/\/t.co\/i2RpF3Ovo9\">pic.twitter.com\/i2RpF3Ovo9<\/a><\/p>\n<p>\u2014 NJ Attorney General (@NewJerseyAG) <a href=\"https:\/\/twitter.com\/NewJerseyAG\/status\/922876028124565511?ref_src=twsrc%5Etfw\">October 24, 2017<\/a><\/p>\n<\/blockquote>\n<p>The document cites the case of a 10-year-old New York boy who police said became ill after eating candy infused with cannabis found in the back seat of his family\u2019s car, but that had nothing to do with Halloween, according to the Associated Press.<\/p>\n<p>Nonetheless, the New Jersey document has been republished across social media and in local news reports in <a href=\"http:\/\/newyork.cbslocal.com\/2017\/10\/27\/halloween-marijuana-edible-warning\/\">New York<\/a>, <a href=\"http:\/\/philadelphia.cbslocal.com\/2017\/10\/26\/marijuana-edibles-halloween-candy\/\">Philadelphia<\/a>, <a href=\"https:\/\/www.local10.com\/health\/parents-of-trick-or-treaters-warned-of-marijuana-candy-on-halloween\">Miami<\/a> and <a href=\"http:\/\/www.fox7austin.com\/news\/us-world-news\/officials-trick-or-treaters-beware-marijuana-candy-edibles\">Austin<\/a>.<\/p>\n<p>Down in Mississippi, the Oct. 9 arrest of a Gulfport man with \u201c760 units of edible candies laced with THC\u201d had the state\u2019s Bureau of Narcotics dirctor <a href=\"http:\/\/www.sunherald.com\/news\/local\/crime\/article178103491.html\">imploring residents to check all treats given to children on Halloween<\/a>.<\/p>\n<p><img loading=\"lazy\" src=\"https:\/\/cannitrol.com\/blog\/\/wp-content\/uploads\/2017\/10\/cbd-candy-is-this-years-halloween-bogeyman-4.jpg\" alt=\"\" width=\"608\" height=\"190\" class=\"aligncenter size-full wp-image-91117\" \/><\/p>\n<p>\u201cThe THC was disguised in popular candy that appears to be peach rings, gummy worms and strawberry gum drops. Each bag of candy had a label that said it had 100 mg of THC inside,\u201d according to <a href=\"http:\/\/www.sunherald.com\/news\/local\/crime\/article178103491.html\">The Sun Herald of South Mississippi<\/a>.<\/p>\n<p>States that have legalized recreational use of marijuana have taken steps to ensure that edibles sold in dispensaries cannot be confused with candy. Colorado\u2019s <a href=\"http:\/\/www.thecannabist.co\/2017\/09\/27\/edibles-thc-potency-labels-colorado\/88724\/\">ban on marijuana edibles shaped like humans, animals, fruits or cartoons<\/a> went into effect on Oct. 1. The state also requires a <a href=\"http:\/\/www.thecannabist.co\/2016\/09\/29\/marijuana-edibles-colorado-thc-symbol\/64093\/\">universal THC symbol stamped<\/a> on each 10-milligram standard serving, the inclusion of potency and contamination testing information, and the barring of words such as \u201ccandy\u201d or \u201ccandies.\u201d The state is also requiring more prominently displayed potency information on the labels of cannabis products. <\/p>\n<figure class=\"figure wp-caption aligncenter\"><img loading=\"lazy\" src=\"https:\/\/cannitrol.com\/blog\/\/wp-content\/uploads\/2017\/10\/cbd-candy-is-this-years-halloween-bogeyman-5.jpg\" alt=\"\" width=\"500\" height=\"333\" class=\"size-medium wp-image-88831\" \/><figcaption class=\"wp-caption-text\">DENVER, CO \u2013 A detail shot of the Colorado State-mandated THC warning diamond on gummies.(Vince Chandler, The Denver Post)<\/figcaption><\/figure>\n<p><a href=\"https:\/\/lcb.wa.gov\/publications\/rules\/OTS-6471_1Final.pdf\">Washington\u2019s laws<\/a> prohibit any marijuana product from being \u201cdesigned to be especially appealing to children\u201d and <a href=\"http:\/\/www.thecannabist.co\/2017\/05\/23\/washington-state-marijuana-laws-changes\/79698\/\">require labeling on all marijuana products<\/a> to state that \u201cthis product contains marijuana.\u201d<\/p>\n<p>As far as Halloween hazards go, children have <a href=\"http:\/\/www.thecannabist.co\/2014\/10\/31\/halloweed-candy-halloween-marijuana\/22326\/\">a greater chance of being fatally injured by a car on Oct. 31 than any other day of the year<\/a>, including the Fourth of July and New Year\u2019s Day.
