John Hickenlooper\u2019s <a href=\"http:\/\/www.denverpost.com\/2017\/11\/01\/colorado-budget-pera-fix\/\">$30.5 billion budget proposal<\/a> for the 2018-19 fiscal year included the allocation of $1.2 million of marijuana tax revenue toward the assembly of a task force within the Colorado Bureau of Investigation that would \u201cinvestigate black market marijuana operations across Colorado.\u201d<\/p>\n<p>\u201cBlack market marijuana cultivation, distribution and exportation continues to increase in prevalence, especially in rural communities where local law enforcement agencies lack the resources necessary to coordinate an effective response,\u201d Hickenlooper wrote in the letter to the legislative Joint Budget Committee. \u201cThe unit will help reduce the number of black market grow operations and the nexus to organized crime.\u201d<\/p>\n<p>The CBI task force is a necessary follow-on to efforts initiated earlier this summer to tighten regulations in the recreational marijuana law that illegal operations utilized as loopholes, said Mark Bolton, senior deputy legal counsel and marijuana adviser to Hickenlooper.<\/p>\n<p>Earlier this year, the state <a href=\"http:\/\/www.thecannabist.co\/2017\/06\/08\/colorado-marijuana-laws-home-grows-plant-counts-law-enforcement\/81109\/\">enacted two laws<\/a> that ratcheted down home-grow caps in residences to 12 plants from 99 plants and established a $6 million fund to help reimburse law enforcement operations\u2019 efforts to curb illegal activity.<\/p>\n<p>If approved, the $1.2 million from the Marijuana Tax Cash Fund would allow for eight new hires at the Colorado Bureau of Investigation for the task force: six investigators, a supervisor and an administrative official, Bolton said.<\/p>\n<p>This special unit would help provide additional resources and expertise throughout the state, but could be especially critical in assisting jurisdictions in rural areas, where illegal grows have settled following <a href=\"http:\/\/www.thecannabist.co\/2017\/06\/28\/denver-marijuana-trafficking-ring-bust\/82592\/\">increased crackdowns<\/a> in urban areas, Bolton said.<\/p>\n<p>\u201cA lot of those rural counties just don\u2019t have the same amount of resources,\u201d Bolton said.<\/p>\n<p>The CBI special unit also, in a sense, would make good on promises made earlier this year to Attorney General Jeff Sessions. <a href=\"http:\/\/www.thecannabist.co\/2017\/08\/24\/jeff-sessions-marijuana-colorado-letters\/86614\/\">In response<\/a> to <a href=\"http:\/\/www.thecannabist.co\/2017\/08\/04\/jeff-sessions-colorado-marijuana-letter-hickenlooper\/85404\/\">Sessions\u2019 questioning<\/a> the state\u2019s ability to effectively and safely regulate marijuana, Hickenlooper and Colorado Attorney General Cynthia Coffman listed actions the state has taken to combat illegal grows and out-of-state diversion.<\/p>\n<p>They noted that they would pursue additional resources to bolster these efforts in the coming year.<\/p>\n<p>\u201cI think we want to do what we can to address this problem,\u201d Bolton said. \u201cI\u2019m hopeful that we\u2019ve put the infrastructure in place that we can really start to eradicate that behavior.\u201d<\/p>\n<p>If approved as proposed, the task force could be funded and created next summer.<\/p>\n<p>Other spending proposals involving the Marijuana Tax Cash Fund include:<\/p>\n<ul>\n<li>Allocating $10 million in the current fiscal year to address rural teacher shortages via \u201cscholarships, incentives, tuition support and other methods\u201d;<\/li>\n<li>For the upcoming fiscal year, allocating $625,000 to expand the state evidence-based mental health program known as the Incredible Years;<\/li>\n<li>Also for next year, eliminating the marijuana impact grant program for local governments, a $1.1 million expenditure, because \u201cdemand for the program\u2019s grants had been only minimal.\u201d That would require legislative approval.<\/li>\n<\/ul>\n<p><em>Denver Post staff writer Brian Eason contributed to this report.<\/em><\/p>\n<div class=\"entry-meta-author\">\n<div class=\"authorimage\"><a class=\"url fn n\" href=\"http:\/\/www.thecannabist.co\/author\/awallace\/\" rel=\"author\"><img src=\"https:\/\/cannitrol.com\/blog\/\/wp-content\/uploads\/2017\/11\/colorado-budget-proposal-calls-for-new-task-force-to-target-illegal-marijuana-ops.jpg\" class=\"authormug\" \/><\/a><\/div>\n<p class=\"author-desc\">Alicia Wallace joined The Cannabist in July 2016, covering national marijuana policy and business.
