Dana Rohrabacher, R-California, and Rep. Earl Blumenauer, D-Oregon, on Wednesday sent a letter co-signed by 64 of their peers to House and Senate leadership.<\/p>\n<p>The letter, addressed to Senate majority leader Mitch McConnell, Democratic Sen. Charles Schumer, House Speaker Paul Ryan and Democratic leader Rep. Nancy Pelosi, urged them to <a href=\"http:\/\/www.thecannabist.co\/2017\/09\/08\/rohrabacher-blumenauer-medical-marijuana-states\/87647\/\">extend the \u201cRohrabacher-Blumenauer\u201d provision that has been in place since December 2014<\/a>, which \u201chas successfully protected patients, providers, and businesses against federal prosecution, so long as they act within the confines of their state\u2019s medical marijuana laws.\u201d <\/p>\n<p>The missive also listed the 46 states, along with two U.S. territories and the District of Columbia, which have enacted some form of legalization of medical cannabis, \u201cfrom CBD oils to the full plant.\u201d<\/p>\n<hr \/>\n<p><strong>Related: <a href=\"http:\/\/www.thecannabist.co\/2017\/11\/29\/sessions-marijuana-enforcement-cole-memo\/93540\/\">Sessions says DOJ just talked \u201cat some length\u201d about marijuana enforcement<\/a><\/strong><\/p>\n<hr \/>\n<p>It was signed by <a href=\"https:\/\/www.govtrack.us\/congress\/members\/CO#representatives\">five of Colorado\u2019s seven House representatives<\/a>: Republicans Ken Buck and Mike Coffman; and Democrats Diana DeGette, Ed Perlmutter and Jared Polis. Republicans Scott Tipton and Doug Lamborn did not sign it. <\/p>\n<p>The measure, previously known as \u201cRohrabacher-Farr\u201d (Rep. Sam Farr retired in 2016), prevents the Justice Department from using its resources to pursue prosecutions involving cannabis when a state\u2019s medical marijuana laws have been followed, and its presence has had an impact in federal courts. <\/p>\n<p>Earlier this year, a judge <a href=\"http:\/\/www.thecannabist.co\/2017\/08\/15\/court-case-doj-medical-marijuana-prosecution\/85992\/\">suspended the case of two California men<\/a> who had pleaded guilty to a federal charge of conspiring to manufacture and sell marijuana; the judge cited the Rohrabacher-Blumenauer amendment in what is believed to be the first such ruling of its kind. <\/p>\n<p>Another case involved medical marijuana growers in Washington state, who were convicted in 2015. <a href=\"http:\/\/www.thecannabist.co\/2017\/10\/19\/kettle-falls-five-washington-marijuana\/90464\/\">In October, federal prosecutors acknowledged<\/a> they shouldn\u2019t have spent taxpayer dollars on the trial. <\/p>\n<p>The provision has been targeted by Attorney General Jeff Sessions, <a href=\"http:\/\/www.thecannabist.co\/2017\/06\/13\/jeff-sessions-medical-marijuana-prosecution\/81410\/\">who in May sent a letter of his own<\/a> to congressional leadership asking that it not be included in the appropriations bill for Fiscal Year 2018, stating: \u201cIt would be unwise for Congress to restrict the discretion of the Department to fund particular prosecutions, particularly in the midst of an historic drug epidemic and potentially long-term uptick in violent crime.\u201d <\/p>\n<p>Earlier this year, the measure was approved in the Senate version of the spending bill, but not the House\u2019s. <\/p>\n<p>The Senate Appropriations Committee <a href=\"http:\/\/www.thecannabist.co\/2017\/07\/27\/senate-appropriations-medical-marijuana\/84714\/\">included the amendment language<\/a> in the Commerce, Justice, Science, and Related Agencies (CJS) appropriations bill for Fiscal Year 2018. <a href=\"http:\/\/www.thecannabist.co\/2017\/09\/06\/house-rules-committee-rejects-marijuana-amendments-spending-bill-2\/87472\/\">In September, the measure was rejected<\/a> from consideration for a floor vote by GOP leadership in the House Rules Committee. <\/p>\n<hr \/>\n<p>(A list of signatories is included below the letter.)<\/p>\n<\/p>\n<p><a href=\"https:\/\/assets.documentcloud.org\/documents\/4314790\/FINAL-Rohrabacher-Blumenauer-Group-Letter-to.pdf\">Rohrabacher-Blumenauer Group Letter to Leadership 11 28 17 (PDF)<\/a><\/p>\n<p><a href=\"https:\/\/assets.documentcloud.org\/documents\/4314790\/FINAL-Rohrabacher-Blumenauer-Group-Letter-to.txt\">Rohrabacher-Blumenauer Group Letter to Leadership 11 28 17 (Text)<\/a><\/p>\n<\/p>\n<p><a href=\"https:\/\/assets.documentcloud.org\/documents\/4314789\/List-of-Signatories-Rohrabacher-Blumenauer.pdf\">List of Signatories Rohrabacher-Blumenauer Letter to Leadership (PDF)<\/a><\/p>\n<p><a href=\"https:\/\/assets.documentcloud.org\/documents\/4314789\/List-of-Signatories-Rohrabacher-Blumenauer.txt\">List of Signatories Rohrabacher-Blumenauer Letter to Leadership (Text)<\/a><\/p>\n<div class=\"entry-meta-author\">\n<div class=\"authorimage\"><a class=\"url fn n\" href=\"http:\/\/www.thecannabist.co\/author\/alabak\/\" rel=\"author\"><img src=\"https:\/\/cannitrol.com\/blog\/\/wp-content\/uploads\/2017\/11\/66-congress-members-call-for-extending-protection-for-medical-marijuana-states.jpg\" class=\"authormug\" \/><\/a><\/div>\n<p class=\"author-desc\">This Colorado native joined The Cannabist in January 2014 as a digital producer, after working behind the scenes for The Denver Post since 1999 in News, Features and Sports as a copy editor and designer.
