width=\"150\" height=\"150\" \/><\/a>Although it is often medical marijuana patients and advocates who are accused of hazy judgment, recent legal developments have us wondering how clearly those in power are thinking.\u00a0 With conflicting decisions and a poor medical marijuana system that was never properly regulated, patient\u2019s safe access has been seriously compromised.<\/p>\n<p>Lawmakers have acted lazy and lethargic when it comes to regulating California\u2019s medical marijuana program.\u00a0 Instead of basing decisions upon research and information, they never checked on how the program is being run or made changes.\u00a0 Now that the system is not functioning as they would like, many are trying to dismantle it.\u00a0 How would <a href=\"http:\/\/www.ssa.gov\/\" target=\"_blank\">Social Security<\/a> fare if we never monitored or adjusted during its 70 year lifespan?\u00a0 The difficult task is actually analyzing what works, speaking with law enforcement, legitimate dispensary workers, lawyers, and patients in order to determine the proper course of action.\u00a0 After 16 years, California is in desperate need of re-reforming its cannabis laws.\u00a0 Patients are confused as to where they can seek relief.<\/p>\n<p>Despite the guarantees of \u201cSafe Access\u201d outlined in<a href=\"http:\/\/www.hr95.org\/Prop215.html\" target=\"_blank\"> Proposition 215<\/a>, many municipalities have taken it upon themselves to interpret the legal language as it suits them.\u00a0 Legal experts have witnessed a series of confusing rulings, with the most recent ruling having been issued approximately a week and a half ago.\u00a0 The July 2<sup>nd<\/sup> ruling by <a href=\"http:\/\/www.courts.ca.gov\/2dca.htm\" target=\"_blank\">The Second Appellate District Court of Appeals<\/a> stated that city municipalities do not have the right to outlaw marijuana dispensaries.\u00a0 The ruling is being applauded by many marijuana advocates and patients.\u00a0 It appears to have at least delayed some of the pending dispensary bans in places such as Long Beach and San Leandro.\u00a0 Joe Elford of <a href=\"http:\/\/www.safeaccessnow.org\/\" target=\"_blank\">Americans for Safe Access <\/a>said \u201cThe court of appeal could not have been clearer in expressing that medical marijuana dispensaries are legal under state law, and that municipalities have no right to ban them.\u201d\u00a0 All eyes will now turn to the<a href=\"http:\/\/www.courts.ca.gov\/supremecourt.htm\" target=\"_blank\"> California\u2019s Supreme Court<\/a> as they will be taking up the issue after the new year and will hopefully end the legal guessing game.<\/p>\n<p>The lawsuits and pending court cases could have been avoided had California\u2019s elected officials taken some sort of initiative on this issue.\u00a0 After <a href=\"http:\/\/en.wikipedia.org\/wiki\/Dennis_Peron\" target=\"_blank\">Dennis Peron<\/a> fought for the right for patients to medicate, California became the first state to permit medical marijuana.\u00a0 Did anyone think that a hands off program for the first legal cannabis state would just govern itself?\u00a0 It is time for our representation to get their heads out of the clouds and
