{"id":8110,"date":"2018-03-02T19:51:54","date_gmt":"2018-03-02T19:51:54","guid":{"rendered":"https:\/\/www.denverpost.com\/?p=2970133"},"modified":"2018-03-02T19:51:54","modified_gmt":"2018-03-02T19:51:54","slug":"last-defendant-in-botched-elyria-swansea-marijuana-heist-that-led-to-murder-pleads-guilty","status":"publish","type":"post","link":"https:\/\/cannitrol.com\/blog\/last-defendant-in-botched-elyria-swansea-marijuana-heist-that-led-to-murder-pleads-guilty\/","title":{"rendered":"Last defendant in botched Elyria Swansea marijuana heist that led to murder pleads guilty"},"content":{"rendered":"<div id=\"wp_fb_like_button\" style=\"margin:5px 0 5px 5px;float:right;height:100px;\"><script src=\"http:\/\/connect.facebook.net\/en_US\/all.js#xfbml=1\"><\/script><fb:like href=\"https:\/\/cannitrol.com\/blog\/last-defendant-in-botched-elyria-swansea-marijuana-heist-that-led-to-murder-pleads-guilty\/\" send=\"true\" layout=\"standard\" width=\"450\" show_faces=\"false\" font=\"arial\" action=\"like\" colorscheme=\"light\"><\/fb:like><\/div><p>Joshua Scott Binns, 33, who was accused of killing a man during a botched marijuana heist, on Friday pleaded guilty to second-degree murder and a crime of violence and now faces up to 48 years in prison.<\/p>\n<p>First-degree murder and felony murder charges that were originally filed against him for the <a href=\"https:\/\/www.denverpost.com\/2016\/11\/09\/denver-coroner-identifies-man-slain-in-elyria-swansea-double-shooting\/\">Nov. 8, 2016, shooting death of Charles Polzin, 50,<\/a> were dismissed as part of the plea agreement, the Denver District Attorney said in a news release.<\/p>\n<p><a href=\"https:\/\/www.denverpost.com\/2018\/02\/27\/guilty-pleas-in-marijuana-robbery-murder\/\">Binns\u2019 three co-defendants<\/a> \u2014 Seth Michael Binns, 27, Ryan Arellano, 28, and Mackenzie Fay, 24 \u2014 on Tuesday entered guilty pleas to various robbery charges in agreements that led to dismissal of felony murder charges.<\/p>\n<p>All four people will be sentenced on April 20.<\/p>\n<p>According to the Denver Grand Jury indictment issued on May 10, <a href=\"https:\/\/www.denverpost.com\/2017\/05\/18\/denver-marijuana-robbery-killing-charles-polzin-indictment\/\">Polzin came into a large amount of marijuana that he wanted to sell<\/a> and reached out to Fay on Facebook, asking if she was interested in the pot. Fay and the three men agreed to meet Polzin, his son, and his son\u2019s girlfriend in Denver\u2019s Elyria Swansea neighborhood.<\/p>\n<p>The Polzins drove from their home in Loveland to an address in the 4700 block of Clayton Street where they met the defendants.<\/p>\n<aside class=\"related right\" \/>\n<p>\u201cJoshua Binns approached and asked, \u2018Hey, you ain\u2019t gonna rob me are ya?\u2019\u201d the indictment says. \u201cCharles Polzin responded, \u2018Nope, are you gonna rob us?\u2019\u201d<\/p>\n<p>At that moment, according to court documents, Joshua Binns pulled out a .40-caliber handgun and unleashed a hail <a href=\"https:\/\/www.denverpost.com\/2016\/11\/08\/tuesday-night-shooting-in-denver-one-person-dead-another-critical\/\">of bullets at Polzin and his son.<\/a>\u00a0The son, who was not identified in the indictment, was seriously wounded. Polzin died at the scene.<\/p>\n<p>According to the indictment, cigarette butts found near Polzin\u2019s vehicle, which was parked nearby, had Joshua Binns\u2019 DNA on them.
