{"id":8406,"date":"2018-07-31T15:23:06","date_gmt":"2018-07-31T15:23:06","guid":{"rendered":"https:\/\/www.denverpost.com\/?p=3151665"},"modified":"2018-07-31T15:23:06","modified_gmt":"2018-07-31T15:23:06","slug":"colorado-medical-marijuana-companies-embroiled-in-federal-patent-dispute","status":"publish","type":"post","link":"https:\/\/cannitrol.com\/blog\/colorado-medical-marijuana-companies-embroiled-in-federal-patent-dispute\/","title":{"rendered":"Colorado medical marijuana companies embroiled in federal patent dispute"},"content":{"rendered":"<div id=\"wp_fb_like_button\" style=\"margin:5px 0 5px 5px;float:right;height:100px;\"><script src=\"http:\/\/connect.facebook.net\/en_US\/all.js#xfbml=1\"><\/script><fb:like href=\"https:\/\/cannitrol.com\/blog\/colorado-medical-marijuana-companies-embroiled-in-federal-patent-dispute\/\" send=\"true\" layout=\"standard\" width=\"450\" show_faces=\"false\" font=\"arial\" action=\"like\" colorscheme=\"light\"><\/fb:like><\/div><div class=\"media_block\"><\/div>\n<div><img src=\"https:\/\/cannitrol.com\/blog\/\/wp-content\/uploads\/2018\/08\/colorado-medical-marijuana-companies-embroiled-in-federal-patent-dispute.jpg\" class=\"ff-og-image-inserted\" \/><\/div>\n<p>A Colorado cannabis company has filed a patent-infringement lawsuit in Denver federal court claiming a rival in Conifer filched its cannabinoid medical product formula.<\/p>\n<p>United Cannabis Corporation of Golden (UCANN) filed the lawsuit in Denver U.S. District Court Monday against Pure Hemp Collective Inc. of Conifer.\u00a0The lawsuit seeks an injunction prohibiting Pure Hemp from copying its formulas that are part of the so-called \u201c911 Patent.\u201d<\/p>\n<p>UCANN is also seeking triple damages against Pure Hemp on the basis that its actions are \u201cwillful,\u201d according to the lawsuit filed by Broomfield attorney Orion Armon.<\/p>\n<p>A message seeking comment left with Pure Hemp on Tuesday was not immediately returned.<\/p>\n<p>UCANN is a biotechnology company that develops cannabis as a medicine and owns a federal patent for \u201chighly enriched extracts of plant cannabinoids,\u201d the lawsuit says. UCANN\u2019s phytocannabinoid therapies treat diseases including chronic pain, paralysis, Crohn\u2019s Disease, glaucoma, autism and cancer by imitating compounds in the human body, the lawsuit says. Over the course of decades, UCANN has developed proprietary liquid formulations of enriched extracts of plant cannabinoids, it says.<\/p>\n<p>The U.S. Food and\u00a0Drug Administration approved a cannabis-based drug for the first time in June 2018 after concluding the abuse risk is negligible, the lawsuit says.<\/p>\n<aside class=\"related right\" \/>\n<p>\u201cDefendant Pure Hemp is a wellness company that makes, markets and sells a\u00a0variety of cannabis products. Upon information and belief, some of these products are\u00a0comprised of cannabinoid formulations identical to the inventions claimed in the \u2019911 Patent,\u201d the lawsuit claims.<\/p>\n<p>UCANN bought Pure Hemp\u2019s Vina Bell product and ran chemical composition tests to see whether the cannabinoid formulations are covered by the 911 Patent and determined that it \u201cdirectly infringes,\u201d the lawsuit says.<\/p>\n<p>On Aug. 15, the U.S. Patent and Trademark Office issued the 911 Patent called \u201ccannabis extracts and methods of preparing and using same,\u201d the lawsuit says.
