Man was house sitting in Commerce City when his wife’s boyfriend came and killed him, affidavit says

A 34-year-old man fatally shot last month while he was house sitting in Commerce City died during an apparent gun battle with his wife’s boyfriend, police say.

According to court documents, Christopher Stockwell was fatally shot in the back of the head by 37-year-old Christopher Toney in an altercation at a home on the on the 9900 block of East 113th Avenue.

An arrest affidavit for Toney says he went to the home to “scare” Stockwell when the shootout happened. Witnesses reported hearing two volleys of gunfire.

Police were called and when they arrived they found Stockwell on the ground inside the house with a pool of blood around his head, the affidavit says. A handgun was underneath his body,

Commerce City police say the shot that killed Stockwell “was determined to have been fired from down the street.”

“It traveled through the wall and struck him inside the residence,” the affidavit says.

Investigators believe that Toney had been enraged with Stockwell for apparently stealing several pounds of marijuana from his home in Wheat Ridge several days earlier.

Toney has been charged with two counts of first-degree murder and  one count of first-degree burglary in the slaying early Feb. 16.

Toney was formally advised of the charges Wednesday, and a preliminary hearing date is due to be set March 16, according to the Adams County District Attorney’s Office.

He is being held without bail at the Adams County jail.
