Congress Asks Obama to Reschedule Marijuana
The separation of forces was among the best ideas hatched in the American founders. With the manager, judicial, and congressional branches, the concept is the fact that each would over see certain facets of the federal government. Unfortunately, the concept wasn’t supposed to have been a game title of hot potato.
However, creating the duty is exactly what we have seen very frequently from D.C. authorities. The separation of forces wasn’t meant to confuse chosen leaders. It did appear to complete exactly that as Leader Obama appeared to forget that deleting marijuana, is definitely an concept that would fall to him, and also the executive run Department of Justice. When asked inside a recent interview, Mr. Obama attempted to change down to deleting marijuana to Congress. The interviewer, getting a clearer knowledge of how our government works, remedied the Leader and tell him that deleting is really a responsibility from the Whitened House.
The Leader attempted for everyone the ball to Congress, but they have came back the volley. Days ago, 18 people of Congress sent instructions to Leader Obama, requesting him to reschedule marijuana, because the current policy “is not sensibleInch. The people of congress are attempting to get marijuana separated from cocaine, heroin, along with other substances which have no medicinal value. According to Yahoo, the letter says “Classifying marijuana as Schedule I in the federal level perpetuates an illegal and irrational system. Schedule I recognizes no medical use, neglecting both medical evidence and also the laws and regulations of up to 50 % from the claims that have legalized medicinal marijuana.Inches Congressman Earl Blumenauer (D-OR), author from the letter stated that reclassifying marijuana “is one step the administration may take to begin to rationalize federal marijuana policy to create it using the advances which are happening in the usa.Inches
Weight loss states legalize both leisure and medicinal marijuana, pressure on Mr. Obama is only going to increase. It is obvious the huge most of People in america are trying to find a significant change. The insufficient action by federal government bodies, and today specially the Whitened House, is definitely an absolutely irresponsible act. Patients and individuals buying leisure marijuana legally under their condition law possess a to be protected, not persecuted by chosen leaders.
Insufficient Banking Remains Challenge for Legal Marijuana Industry
A week ago we spoke concerning the fact our Commander in Chief looks like it’s unaware of the separation of forces. President Obama attempted to assert that he’s powerless to assist reschedule marijuana laws and regulations. He obviously was remedied through the reporter performing the job interview and informed the Department of Justice works best for the Leader. Mr. Obama is extremely wise and it is an old leader from the Harvard Law Review. This would lead someone to think that his outward naive behavior was intentional, something that’s simply not likely to sit well with reformers and medicinal marijuana patients.

We learned now that federal government bodies were matching with local police in Colorado and Boulder to conduct raids. While the instinct for a lot of would be to think that federal government bodies go back on their own word, that won’t be. So far, the Department of Justice has stored the majority of the particulars secret for the time being, but spokesperson Shaun Dorschner has stated the actions from the DOJ are in conjuction with the previous claims that they’ll respect condition law. Mr. Dorschner established that individuals being raided were in breach from the concepts the DOJ mentioned formerly which incorporated efforts to avoid supplying minors and supplying criminal businesses among other focal points. Even while increasingly more People in america accept using medical and leisure marijuana, there’s frequently still a stigma mounted on it for moms and dads. There has been most cases where government bodies have a parent’s child over marijuana possession. Picture this scenario if your parent lost a young child over alcohol possession. In reaction, Mickey Martin has assisted created the audience Parents 4 Pot. He lately referred to the mission from the northern California organization by saying “What we desire to do would be to alter the way people understand and discuss cannabis within our community.” Parents 4 Pot can also be attempting to bring awareness to situations where children require medicinal marijuana. There has been many recent legal changes, such as with Nj, in which the laws and regulations happen to be changed to permit sick children to get medical cannabis. Martin also spoke about families being damaged by outdated marijuana laws and regulations. “There are lots of parents who lose their freedom, or whose children lose their freedom, every single day to those guidelines and laws and regulations, so that as a society we sit by watching. It’s not okay any longer.” He stated.

Washington Attempting to Fix Banking Situation to gather Marijuana Taxes
Aside from the pending fear of operating outdoors of federal law, marijuana dispensary operators frequently cite deficiencies in use of banking among the biggest obstacles to operate around. Recent claims through the Department of Justice may reduce some fears of challenge with federal law, however, many are wishing the second of these two fears is worked with correctly
Washington Condition is attempting to produce a legitimate legal marijuana market, with banking high in priority list. While most professionals and condition level government bodies are involved about how exactly the problem will have out, apparently condition Treasurer, Jim McIntire, is do not require. He established that Bank of the usa will handle the accounts in which the condition will deposit taxes collected from legal marijuana. In relation to its federal government bodies coming following the banks, Mr. McIntire told reporters now “I’m much less concerned about it, it’s really an advantage of getting Bank of the usa as the contractor. It’s unlikely, I believe, that the us government would raid them. And they’re large enough to look for on their own this.”
The statement might be very telling. Condition Treasurer McIntire isn’t worried while he feels the federal government won’t pursue a sizable banking institution. After watching deficiencies in punishment passed out in 2008 following the bank bailout a lot of us might have suspected just as much, but it’s an unexpected to listen to authorities say just as much. Would marijuana reform happen to be brought in faster when the major finance gamers were aboard earlier? Could patients throughout have enhanced their quality of existence years back?
No matter what might have to transpire soon because the first applicant costs for growing licenses are required to become collected in November. Unfortunately, the applying process could face delays when the banking scenario is not resolved. Once the condition understands how to setup banking for marijuana taxes, it ought to hopefully create shops to achieve access.

MPP places pro marijuana ad outside of NFL opener…
Marijuana Policy Project has proved to be invaluable in highlighting the truth about cannabis. The group made headlines with their recent NASCAR ad and will not stop there. Their next target is the NFL and their policy on testing players for marijuana use. An ad was placed outside of Denver’s Mile High Stadium that read ” Stop Driving Players to Drink. A Safer Choice is Now Legal Here.” NFL players have come under harsh criticism for the high number of DUI arrests among them. The NFL permits drinking but comes down harsh on players testing positive for marijuana. Players are suspended, for multiple games with former Miami Dolphin, Ricky Williams, being one if the most high profile examples of the policy. Mason Tvert of MPP feels the NFL ‘s stance is contradictory and recently said “NFL players are being told that they can go out and get completely drunk, but face no punishment from the league, but if a player gets caught using marijuana, they could be fined hundreds of thousands of dollars, forced to sit out games and deemed a troublemaker.”

Justice Department Statement Will Not Immediately Solve IRS Problems For Marijuana Industry…
The statements by the Justice Department, last week, indicating they would respect state laws certainly was a boost for many patients and caregivers. However, this is only step one. Another major obstacle to overcome has to do with finance. Because of federal pressure, banks will not allow collectives to set up business accounts. The result, an untraceable cash business that helps neither the Feds (they can’t easily follow an electronic paper trail if a dispensary is operating illegally) or collective operators who have to keep cash and marijuana on hand. Armed security at dispensaries is also illegal. This forces collectives to have a bulls eye on their backs. Another issue for dispensary operators is the fact that they cannot deduct normal business expenses that allow other small businesses to keep their doors open. None of this benefits the patient and since prohibition appears dead the IRS should move quickly. Of course it is likely they will not.

The finish is nigh? Feds claim forget about interference with condition marijuana laws and regulations
The cost from the fight against drugs continues to be well recorded. The majority of us understand the rising violence south in our border, patients influenced by insufficient access, people imprisoned for possession, and also the expense of prohibition towards the tax payer. We at marijuana.internet wrote about this for a while now.
We’ve learned about these problems again and again, without a whisper of the sensible response from the us government. Just whenever we all increased fed up with the legal stalemate with federal government bodies attempting to hold condition law under control, it seems a significant alternation in federal policy might be going ahead. Last week, the Justice Department introduced it wasn’t likely to prosecute marijuana crimes legal under condition law. While the best objective of reform activists might be reclassification, this might indeed be federal government bodies waiving the whitened flag. Paul Armantano of NORML stated “It certainly seems to become potentially “the start of the finish” in relation to its prohibition.
The timing from the DOJ statement is curious because the agency was asked for an approaching forum on medicinal marijuana and repairing condition versus. federal law. Eric Holder was asked towards the conference and lots of were searching toward getting him obvious in the murky waters that represent the Whitened House’s stance on marijuana. Single questions about marijuana have demonstrated hard for Holder and the staff to reply to formerly. They have stated lack of knowledge towards the research while concurrently declining to confess marijuana was less destructive than heroin along with other opiates. Perhaps a congressional Q&A with follow-up questions wasn’t going to talk about well for that already battling Attorney General.
The general public has significantly transformed their position on marijuana, and they’ll not soon be returning towards the times of “Reefer Madness”. The new policy direction means a lot of things if federal government bodies maintain their word. Many companies and traders happen to be waiting for some indication that they’ll ‘t be jailed for joining the most popular growing industry. Patients might have more bit of mind when attempting to gain access to medication.

Presumptive GOP Nominee Mitt Romney Irritated by Marijuana and Gay Marriage Questions…
The GOP primary race is all but officially over with Mitt Romney expected to accept the party’s nomination in August. The election season is heating up and the candidates now will be grilled over policy related issues on a daily basis. Earlier in the week, North Carolina passed a ban on Same Sex Marriage and Civil Unions. Proponents of the ban feel they are protecting marriage’s traditional values while opponents are concerned with civil rights and children who stand to lose health benefits. Mitt Romney indicated he did not agree with same sex marriage while President Obama has now come out in support of same sex couples being wed. While the marriage issue is predictably a large political issue, it is often now being followed up with questions on marijuana reform, showing that reporters are taking the issue seriously. At a campaign stop in Colorado on Wednesday, Mitt Romney was asked about both issues to which he responded by saying “Aren’t there issues of significance you would like to talk about?” Many residents in Colorado likely feel that these are issues of significance, especially to struggling patients and families. The fact that marijuana reform is now being asked as much as other social issues demonstrates its growing importance to Americans.

Attempt to Defund Marijuana Raids Fails but Shows Promise…
Yesterday marijuana.net ran entitled “Lawmakers Propose New Tactic in Fight For Marijuana Reform” which described members of the House attempting to prevent the Department of Justice from using any funds to conduct marijuana dispensary raids. The gesture was significant and signals a new method policy makers can use in order to push issue of marijuana reform. The vote did fail by with a 163-262 vote. Only 29 Republicans supported the measure while seventy-three percent of democrats were in favor of the bill. The margin is not politically insurmountable and it will be interesting to see if future votes will be tighter or even in favor of outlawing the raids.
Arizona Courts Rule that Contracts With Medical Marijuana Companies are Not Enforceable…
Arizona has passed its fair share of confusing and seemingly unenforceable laws in recent years. Another ruling earlier this week added to the state’s legal confusion. Michele Rene Hammer and Mark Haile, issued a $500,000 loan to a medical marijuana company in Colorado. When the company failed to repay the loan Hammer and Haile filed a lawsuit. Maricopa County, Ariz., Superior Court Judge Michael McVey threw the case out of court because federal law prohibits marijuana on any level, even though the state the judge rules in does permit medical marijuana. Randy Nussbaum, who is from the firm representing Hammer and Haile, fears that no contract with any medical marijuana company is valid in Arizona now. Specifically Nussbaum said “The macro view of this is, if it’s true that anyone who has a contractual relationship with anyone dispensing medical marijuana and that contract is not enforceable, how does anyone enforce a legitimate contract in this business?”

Prominent Advocacy Group Regulate Marijuana Like Alcohol Takes to the Airwaves…
One of the most successful and influential marijuana advocacy groups is about to take their successful message even further. “Regulate Marijuana Like Alcohol” is largely responsible for Amendment 64, which would accomplish exactly what the group’s name states. If passed, marijuana would be governed in a way very similar to liquor. The group was instrumental in collecting the over 80,000 signatures needed to get the marijuana initiative onto the ballot. As a result, Colorado residents will have the chance to vote on legalizing cannabis. Now the group will be running its first television ads over the Mother’s Day weekend. You can look out for their “Dear Mom” ad on several broadcasts including Friday’s “Today Show’, “Ellen” show and the Mother’s Day episode of “The Doctors”.
Florida Leads the Country with Indoor Marijuana Grow Busts
Most people probably picture California or Colorado when they think of marijuana in the United States. With approximately one million legal medical marijuana cardholders between the two states, one would not be incorrect to associate cannabis with the two regions. Another state making the news for its marijuana culture is Florida, however the Sunshine State does not permit legal use of cannabis.
The annual National Drug Threat Assessment report was released earlier this year by the United States Department of Justice. In fact, Florida now holds the title as the number one state for indoor marijuana growing busts. Perhaps that is not a title they were seeking, but it may push the state toward a real conversation about marijuana reform. Police have voiced their frustration with detecting the grow operations, as they are far less detectable indoors.
Florida politics have created a very aggressive anti marijuana stance. However, there have been new resolutions recently proposed in Florida’s legislature, although many political analysts are not confident they will survive the debate by Florida lawmakers. The greater point is that clearly there is a split on how the public views marijuana in Florida. Demand seems to be very high in Florida, despite marijuana not being granted legal acceptance.
Many critics will point to the confiscations as an indication that marijuana use is on the rise. While this may be true, there may be other reasons for this increase. A leading marijuana lawyer in Florida, Mark S. Germain, stated that growers have moved operations indoors after the passing of the Marijuana Grow House Eradication Act, which greatly increased growing and cultivation penalties. So while Florida may have a title they could do without, it remains to be seen if there truly is more marijuana being grown. It seems possible that with stricter laws growers are making sure not to be seen in the open. In the end, if they are embarrassed by such a statistic, they may in fact want to consider adopting the medical marijuana legislation sitting on their lap.
